These Terms and Conditions govern the Maxwell Massage PLLC website, appointment policies, and optional communication programs. By scheduling an appointment or affirmatively opting in to a communication program, you agree to the terms that apply to that activity. Use of the public website is also subject to the website-use terms below.
1. About Our Services
Program Name: Maxwell Massage Appointment Reminders & Client Communication
Maxwell Massage PLLC is a licensed massage therapy practice located at 100 Wall Street, Seattle, WA 98121. We provide medical and relaxation massage therapy services. Our text messaging program is used to send appointment reminders, respond to client questions, and communicate practice updates relevant to your care.
2. Text Messaging Terms
By providing your mobile phone number and opting in to our text messaging program, you consent to receive recurring SMS messages from Maxwell Massage PLLC related to appointment reminders, scheduling, and customer care.
Consent is collected through explicit opt in actions and is tied to the phone number provided at the time of opt in.
Messages may include:
- Appointment reminders and confirmations
- Responses to scheduling and administrative questions
- Practice updates (e.g., schedule changes, closures)
Text messaging is not our secure patient portal. Do not use SMS to send medical records, detailed treatment information, or other information that law or our privacy practices require us to handle through a more secure channel. If a message requires secure communication, we will direct you to Jane.
Message Frequency: Message frequency varies depending on your appointments and interactions with us.
Message & Data Rates: Message and data rates may apply. Check with your mobile carrier for details about your messaging plan.
Opt-Out
You can opt out of receiving text messages at any time by replying STOP to any message from us. After opting out, you will receive a single confirmation message and no further texts will be sent unless you opt in again.
Help
For help with our text messaging program, reply HELP to any message or contact us at:
- Phone: (206) 448-9407
- Email: info@maxwell-massage.com
Delivery
Message delivery depends on your carrier and network availability and is not guaranteed. Wireless carriers are not responsible for delayed or undelivered messages.
3. Opt-In and Consent
You may expressly opt in to receive recurring SMS messages from Maxwell Massage PLLC through the following methods:
- By text: By texting START to our messaging number after the program disclosure is presented on our website or by our staff.
- In Person: By providing your mobile phone number and signing the SMS consent field on our patient intake form at the time of your appointment.
By opting in, you confirm that you are the account holder or authorized user of the mobile phone number provided, that you are at least 18 years of age, and that you expressly consent to receive the recurring SMS messages described above. Consent is not required as a condition of service. To stop receiving messages at any time, reply STOP. For help, reply HELP.
4. Last-Minute Availability Emails
You may subscribe to our last-minute availability email list by checking the separate consent box on the subscription page and confirming your email address through our double-opt-in email. You may unsubscribe at any time using the unsubscribe link included in every email.
Each email may include a link to book an open appointment directly. Last-minute appointments are available on a first-come, first-served basis: a booking link does not hold an appointment, and an opening is not confirmed until your booking is completed.
We do not use email-open or link-click tracking for this program. See our Privacy Policy and Consumer Health Data Privacy Policy for details.
5. Website Use
The content on the Maxwell Massage PLLC website (maxwell-massage.com) is provided for general informational purposes only. It does not constitute medical advice. Always consult with a qualified healthcare provider regarding any health concerns.
This website disclaimer does not limit the professional duties that apply when a licensed therapist provides care to you.
We reserve the right to update or modify our website content at any time without prior notice.
6. Appointment Policies
- Appointments can be scheduled online through our scheduling platform (Jane), by phone at (206) 448-9407, or by text at (206) 448-9407 (our SMS program terms in Section 2 apply).
- For weekday appointments, please arrive 10-15 minutes early.
- For after-hours and weekend appointments, arrive at your scheduled time. The door will be locked until your therapist opens it.
- Electronic intake forms will be sent to you via text or email prior to your first visit.
Cancellation & No-Show Policy
We require at least 48 hours' notice to cancel or reschedule an appointment. Late cancellations (less than 48 hours' notice) and no-shows will be charged a $50 fee. This fee will be charged to the card on file. If you need to cancel or reschedule, please call (206) 448-9407 or text (206) 448-9407 (our SMS program terms in Section 2 apply).
7. Payment Terms
Payment is required for all massage therapy services rendered. By scheduling an appointment with Maxwell Massage PLLC, you agree to the following payment terms:
- Payment Method: We accept credit and debit cards. A valid card is required to be kept on file.
- Card on File: A card on file is required to book, including when care is covered by insurance, VA Community Care, or workers’ compensation. It is held for the cancellation and no-show policy above and does not mean that we will charge you for a service we bill directly to a payer. When you owe a self-pay amount or other patient responsibility, we will charge or collect it according to the payment option and price disclosed for that service. The card may also be charged for a late-cancellation or no-show fee.
- Direct Billing: For eligible car-accident claims, workers’ compensation or personal-injury claims, and authorized VA Community Care, we bill the applicable insurer, claims administrator, or program directly.
- Commercial Insurance: For commercial health plans, Maxwell Massage therapists are out-of-network providers. We may provide a Superbill for you to submit for possible reimbursement. A Superbill is not a promise that the plan will accept the claim or reimburse any amount; coverage decisions are made by the plan.
- HSA/FSA: We accept Health Savings Account (HSA) and Flexible Spending Account (FSA) cards.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy, Consumer Health Data Privacy Policy, and Notice of Privacy Practices for information on how we collect, use, and protect information. We do not sell, rent, or share your personal information with third parties for marketing purposes.
9. Client Reviews and Testimonials
Reviews shown on this website are real reviews left by clients on public platforms such as Google. We identify reviewers by their initials rather than their full names.
We may shorten a review for length, or leave out a part of it that does not concern the service we provide. Where we have shortened a review, we mark it with an ellipsis. We do not change the wording of a review, alter what it says, or leave out criticism in order to make a review appear more favorable than it is. The complete, unedited reviews remain publicly visible on the platform where they were posted.
10. Intellectual Property
All content on this website, including text, images, logos, and design, is the property of Maxwell Massage PLLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without written permission.
11. Limitation of Liability
The public website and optional messaging services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Maxwell Massage PLLC is not liable for indirect, incidental, special, or consequential loss caused solely by an interruption, delay, or error in those public website or messaging services. This section does not limit liability for professional health care services, gross negligence or willful misconduct, or any right or remedy that cannot lawfully be waived.
12. Changes to These Terms
We may update these Terms and Conditions as our services or legal obligations change. We will post the revised terms and update the date above. Changes apply prospectively. When law requires separate notice or consent, we will provide it before the change applies to you.
13. Governing Law
These Terms and Conditions are governed by Washington law, without limiting any consumer protection or other right that cannot be waived. Unless applicable law requires otherwise, disputes arising from these terms will be resolved in a court of competent jurisdiction in King County, Washington.
